25 May 2012
A 58-year-old who was locked out of his house by his angry girlfriend was banned from driving after police found him drunk and asleep in his car.
Ernie Oakes had been drinking heavily in a pub before he drove home on Thursday May 10, the court heard. Police had been tipped off by someone who saw Oakes driving erratically through Bermondsey.
The bonnet was warm when the police arrived and the keys were on the front passenger’s seat.
His defending solicitor said: “This is a defendant who has some significant issues within the home.
“He is the carer for his partner...She suffers from multiple sclerosis. “He accepts that he drank a significant amount of alcohol. “He wasn’t allowed back in [his home] because his partner had been angry that he had been drinking,” he said.

His partner relies on him for a significant amount of care and to drive her to her treatment sessions twice a week, the court heard. Oakes pleaded guilty to being in charge of a vehicle whilst unfit through drink and the court was told that he had a “relatively clean” record, apart from one conviction for battery in 2010.
Mrs Fleming, the chair of the magistrate panel, said: “We do feel that this is at the serious end of things, the reading was high and you had been drinking quite heavily. “You know your responsibilities at home.”
Oakes, of Southwark Park Road in Bermondsey, was banned from driving for two months and fined £110.
