A prolific offender with 80 previous convictions was handed 80 days in prison, after pleading guilty to stealing two packets of salmon and assaulting a shop assistant in a petrol garage.
Mark Kelly, 34, of Walliston Close, SE1, claims to have been extremely drunk when he had an argument with the assistant of the BP garage in the New Kent Road just after 7.30 on Wednesday, March 18.
Kelly was thrown out of the shop before the police were called and the packets of salmon - worth £7.10 - were found, along with a small amount of cannabis resin.
Appeals for a suspended sentence from the defence were ignored by DJ Somjee, who said: "Because you knew you were banned and because you assaulted a shop assistant while carrying out his duty - a custodial sentence is my only solution."
